These Terms of Use and Service ("Terms") form a binding agreement between you and Swiss IT Products ("Swiss IT Products," "we," "us," or "our") and govern your access to and use of the Pilot ShareCraft mobile application and related services (collectively, the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract to use the App. By using the App, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
2. The Service
Pilot ShareCraft is a tool that helps pilots, aircraft owners, partnerships, and groups organize shared aircraft operations — including flight scheduling, a digital pilot logbook, maintenance and inspection tracking, fuel management, and cost and expense tracking. The App is provided for organizational, record-keeping, and collaboration convenience only.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your personal or internal business use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.
5. Shared Aircraft and Member Conduct
The App allows owners to invite other pilots to share an aircraft and to view and contribute shared data. You are responsible for the data you enter and for deciding whom you invite. Members of an aircraft may view shared information such as names, email addresses, bookings, flight logs, maintenance records, fuel entries, and member balances. We are not responsible for the conduct of other members or for the accuracy of data entered by you or other members. Any financial arrangements, cost-sharing, dues, or settlements among members are solely between those members; we are not a party to and do not process those arrangements.
6. Subscriptions, Billing, and Auto-Renewal
- Free tier and Pro. Certain features are available at no cost. Pro collaboration features (including inviting other pilots to share an aircraft) require a paid subscription, "ShareCraft Pro."
- Price and trial. ShareCraft Pro is offered as a monthly or annual subscription priced at $24.99 per month or $249.99 per year, including a 30-day free trial for eligible new subscribers. Prices may vary by region and are subject to change.
- Billing. Payment is charged to your Apple ID account upon confirmation of purchase, after any applicable free-trial period.
- Auto-renewal. The subscription automatically renews for successive periods unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
- Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID account settings. If you cancel during a free trial, you will not be charged; any unused portion of a free trial is forfeited when you purchase a subscription.
- Apple terms. Purchases are processed by Apple and are also subject to Apple's applicable terms, including the Apple Media Services Terms and the standard End User License Agreement (EULA). Refunds, where available, are handled by Apple in accordance with its policies.
7. Acceptable Use
You agree not to: (a) use the App for any unlawful, fraudulent, or harmful purpose; (b) access or attempt to access data or accounts that are not yours; (c) interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems; (d) upload content that is unlawful, infringing, or that you do not have the right to share; or (e) use the App in any way that violates these Terms or applicable law.
8. Your Content and Data
You retain ownership of the data and content you submit to the App ("Your Content"). You grant us a limited license to host, store, process, and display Your Content as necessary to operate and provide the App, including sharing it with other members of an aircraft as you direct. You are responsible for the accuracy, legality, and appropriateness of Your Content.
9. Aviation Disclaimer — Important
Pilot ShareCraft is an organizational and record-keeping aid. It is not a source of official aircraft records and is not a substitute for your legal and regulatory obligations as a pilot, owner, or operator. Estimates and calculations provided by the App (including distances, flight times, fuel burn, range and fuel-stop warnings, currency, and maintenance or inspection status) are approximations for convenience only and may be inaccurate or incomplete.
You are solely responsible for verifying all information against official sources, for ensuring the airworthiness of any aircraft, for compliance with all applicable aviation regulations (including those of the FAA or your relevant authority), and for the safe planning and conduct of every flight. Never rely on the App as the sole basis for any flight, maintenance, airworthiness, regulatory, or financial decision.
10. Third-Party Services
The App relies on third-party services, including Apple and Google Firebase, and may reference third-party data such as airport or aircraft-registration information. We do not control and are not responsible for third-party services or data, and your use of them may be subject to their own terms.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DATA WILL BE ACCURATE OR PRESERVED.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SWISS IT PRODUCTS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP — INCLUDING ANY RELIANCE ON DATA, CALCULATIONS, OR NOTIFICATIONS IN THE APP FOR FLIGHT, MAINTENANCE, AIRWORTHINESS, REGULATORY, OR FINANCIAL DECISIONS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR USD $50.
13. Indemnification
You agree to indemnify and hold harmless Swiss IT Products and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, Your Content, or your violation of these Terms or applicable law.
14. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App at our discretion, including for violation of these Terms. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
15. Changes to the App and to These Terms
We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time; when we make material changes, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of [insert state], United States, without regard to its conflict-of-laws principles, except where a mandatory law of your country of residence provides otherwise. Any disputes will be subject to the exclusive jurisdiction of the courts located in [insert venue], to the extent permitted by applicable law.
